INTRODUCTION

This Privacy Policy describes how we collect, use and share information when you use our Services. The terms "Sygma", "we," "us," or "our" mean Sygma Labs, Inc. d/b/a Magic Number and any legal subsidiaries and affiliates. The term "Services," means, collectively, our website at www.magicnumberapp.com ("Website"), mobile applications including the Magic Number Application (the "App"), applications, online tools, email notifications; and our consulting, referrals, and sponsorships (whether provided by phone or online); and our marketing and advertising activities. By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you consent to the collection, use, and sharing of your information as described in this Privacy Policy.

Your use of Sygma's Services is at all times subject to our Terms of Use (which incorporates this Privacy Policy). Any terms we use in this Privacy Policy without defining them have the definitions given in our Terms of Use. 1. WHAT THIS PRIVACY POLICY COVERS

This Privacy Policy covers how we treat Personal Information that we gather when you access or use our Services. "Personal Information" means any information or data that directly or indirectly identifies, describes, relates to, or is reasonably capable of being associated with, or can reasonably link, to a particular individual, consumer or household and has the meanings ascribed under applicable data privacy laws. This Privacy Policy applies only to Personal Information we collect through our own Services and not to the practices of companies that we do not own or control, or people that we do not manage. This Privacy Policy does not apply to any third-party sites that may link to or be accessible from our Website or applications. In some situations, we may rely on exemptions or other permitted conduct under applicable laws, including collecting, using, disclosing or storing Personal Information. Information about your business is not typically Personal Information. Anonymized information is also not considered Personal Information for the purposes of this notice. We may anonymize any Personal Information in our custody, in which case it will cease to be Personal Information.

Communications with Third Parties

Our App records phone conversations and transcribes phone conversations ("Recording(s)"). When a customer uses our App or our Services, they are responsible for obtaining consent from any third parties before making a Recording of any conversations.

Telephone Communications

Unless a party opts out through the methods set forth in Section 2.3 below, Sygma may share your Personal Information in connection with the Recording. IF YOU PROVIDE YOUR CONSENT TO A RECORDING, SYGMA MAY PROCESS, MODIFY AND STORE YOUR PERSONAL INFORMATION. MESSAGE AND DATA RATES MAY APPLY. TELEPHONE COMMUNICATIONS BETWEEN YOU AND US MAY BE RECORDED TO PROVIDE OUR SERVICES OR MONITORED FOR QUALITY CONTROL PURPOSES. BY PROVIDING INFORMATION TO US, YOU EXPRESSLY CONSENT TO THE RECORDING OF THESE TELEPHONE COMMUNICATIONS.

YOU MAY OPT OUT AT ANY TIME BY TELLING THE REPRESENTATIVE ON THE PHONE THAT YOU DO NOT WANT YOUR CONVERSATION TO BE RECORDED OR THAT YOU NO LONGER WANT TO BE CONTACTED BY TELEPHONE COMMUNICATIONS.

3. CATEGORIES OF PERSONAL INFORMATION WE COLLECT

Over the last 12 months, Sygma has collected the following categories of Personal Information from users of our Services. For each category, we list some examples of the type of data collected.

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you with notice or obtaining your consent where required.

4. CATEGORIES OF SOURCES OF PERSONAL INFORMATION

We collect Personal Information from the following categories of sources:

Directly From You

We collect information you provide when you create an account or interact with our Services, such as when you register for an account, fill out forms or surveys, communicate with us via email, phone, or chat assistant, participate in promotions or events, or submit reviews or other content. You are responsible for any conversations you share through our Services, including any personal information ("User-Generated Content"). Please be aware that User-Generated Content is shared at your own risk. We cannot control how other users may use or distribute your content, nor can we guarantee that privacy settings or security measures will prevent unauthorized access. If you wish to request removal of your content from our community forum, please contact us at support@magicnumberapp.com. While we will make reasonable efforts to honor such requests, complete removal may not always be possible (for example, if copies remain in cached or archived pages or have been copied by other users). If we are unable to remove your content, we will inform you and explain why. Use of all content within our Services is subject to our Terms of Use.

Automatically Through Our Services

When you use or access our Services, we automatically collect certain information as you use our Services, including device data, such as your computer's or mobile device's operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers, language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 4G), and general location information such as city, state, country or geographic area; and online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, duration of access, and whether you have opened our marketing emails or clicked links within them, usage patterns, and data collected through cookies and similar tracking technologies. See Section 7 (Tracking Tools). If you enable location services or provide a location, we may collect geolocation data (such as your approximate location based on your IP address).

From Third Parties

We may receive information about you from third-party sources, which may include service providers assisting in delivering our Services, business partners offering complementary services, advertising partners, analytics providers, and social media platforms such as LinkedIn or Facebook. These third parties may provide us with information to enhance our Services, personalize your experience, or for other operational purposes.

From Public Sources

We may collect Personal Information from public databases. Additionally, if you are using our Services on behalf of a business, we might collect business contact information from public sources or directories.

5. OUR COMMERCIAL OR BUSINESS PURPOSES FOR COLLECTING PERSONAL INFORMATION

We collect and use Personal Information for a variety of commercial and business purposes, in accordance with the terms of applicable privacy laws. The purposes for which we collect and use information include:

Providing and Improving Our Services

We may use your information to operate, maintain, and enhance our App, Website and Services. This includes offering customer support, personalizing your experience, and analyzing usage to improve our Services.

Communicating With You

We may contact you to respond to your questions, provide customer support, send service-related messages (like confirmations and updates), and deliver informational alerts or reminders about our Services. These communications may occur via the App. You can opt out of non-essential messages at any time by following the provided instructions.

Marketing and Advertising

We use your information to send you direct marketing communications about our products, surveys, Services or promotions from Sygma that may be of interest to you or our related services. This may be via email, or telephone. Our processing of your Personal Information for marketing purposes is based on our legitimate interest, on your consent, or on other legal basis permitted by applicable laws. You can opt out of marketing emails by contacting us via email, using the unsubscribe link in those emails, or implementing a third-party automated unsubscriber in your email account, like Gmail's built-in "Auto Unsubscribe" feature). You can opt out of text messages by following the provided instructions (such as texting "STOP"). See Section 2 (Consent and Opt-Out Rights) above for more information.

For Research and Development

We may use your personal information for research and development purposes, including to analyze and improve our Services and our business. As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information we collect. We make Personal Information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and disclose it to third parties for our lawful business purposes, including to analyze and improve our Services and promote our business.

Security and Fraud Prevention

We may use your information to protect the integrity of our Services, detect and prevent fraudulent activities, and ensure the safety of our users. If you post content on our platform (such as a review or comment), and we receive a claim that it infringes someone's rights or violates our policies, we may review and use your data to address the issue.

Legal Compliance

To comply with applicable laws (including any necessary obligations for archiving Personal Information), regulations, legal processes, or governmental requests, and to enforce our terms and policies.

We will not use your Personal Information for materially different purposes without updating this Privacy Policy or otherwise notifying you as required by law.

6. HOW WE SHARE YOUR PERSONAL INFORMATION

We disclose your Personal Information to the categories of third parties described below for business or commercial purposes. In some cases—depending on the laws that apply to you—certain of these disclosures may be considered a "sale" of your Personal Information or the "sharing" of your Personal Information for cross-context behavioral advertising. Please see Section 2 (Consent and Opt-Out Rights) above for more information on your choices. We do not disclose Personal Information to third parties for their own direct marketing purposes without your consent.

The categories of third parties with whom we share Personal Information include:

Service Providers and Vendors

Which includes third-party companies and contractors that assist us in operating our Services, such as customer support, data processing, marketing, IT services, email delivery, hosting, and other operational support. These providers are contractually obligated to use Personal Information solely to perform services on our behalf.

Analytics Partners

Which include companies that analyze usage data of the App to help us understand user behavior and improve our Services. These providers collect information such as user interactions to generate insights into application performance and user engagement.

Social Media Platforms

Which include platforms like Meta (including Facebook and Instagram), X, Pinterest, and LinkedIn, especially when users engage with our social media features or widgets. Information may be shared with these platforms to facilitate social sharing, enable account linking, or for advertising purposes.

Parties You Authorize, Access or Authenticate

Including any person who, in our reasonable judgment, is authorized to receive your Personal Information as your agent, including as a result of your business dealings with that person (for example, your attorney).

Legal and Regulatory Authorities

Which include any governmental authority to which we disclose your information to comply with legal obligations, enforce our policies, respond to legal requests, or protect our rights and the rights of others.

Business Transfers

If we undergo a business transaction such as a merger, acquisition, reorganization, or sale of assets, your Personal Information may be transferred as part of the transaction. In such cases, the acquiring company or merging partner will gain access to the data we maintain (including Personal Information) and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy. We will provide notice to you (for example, via email or a prominent notice on our Website) if your Personal Information becomes subject to a different privacy policy as a result of such a transaction.

Data That Is Not Personal Information

We may aggregate, de-identify, or anonymize Personal Information so that it is no longer associated with an identifiable individual and it is no longer Personal Information. For example, we may compile statistical information about all the users of our Services in a form that does not identify any user personally. We use such aggregated or anonymized data for our lawful business purposes, such as analyzing usage trends, and developing new services. Importantly, when we share aggregated or de-identified information, we ensure that it cannot reasonably be used to re-identify any particular person.

7. TRACKING TOOLS

Our Services use cookies, web beacons, and similar tracking technologies (collectively, "Cookies") to enhance your experience, analyze usage, and deliver personalized content and ads. Cookies are small text files placed on your device to recognize your browser and remember certain information. Web beacons are tiny transparent images embedded in websites or emails that, in conjunction with cookies, help track activities like page views or email opens. 8. INTERACTIONS WITH THIRD PARTIES

When you engage with third parties through our Services (such as business partners, or by navigating to external websites or social media platforms) please be aware that these entities are independent controllers of your Personal Information. This means they handle your data according to their own privacy policies and practices, which are not governed by this Privacy Policy. If you click on a link to an external website or interact with a social media feature on our Website, any data you provide will be subject to that third party's privacy practices. We encourage you to review the privacy policies of any third-party entities you interact with to understand how they collect, use, and protect your information.

9. DATA SECURITY

We use a variety of administrative, technical, and physical safeguards to protect the Personal Information we collect from loss, theft, misuse, and unauthorized access, disclosure, alteration, or destruction. These security measures are designed in line with the sensitivity of the data involved. We restrict access to Personal Information to authorized employees and contractors who need that information to operate, develop, or improve our Services. We also require our service providers to implement reasonable security measures to protect the data we share with them.

Despite our efforts, no security measure is 100% perfect. We cannot guarantee the absolute security of your information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of data. It is important that you also play a role in keeping your information secure. Where we have given you (or where you have chosen) a password or credentials for access to certain parts of our Services (if in the future we offer accounts or login functionality), you are responsible for keeping those credentials confidential and for immediately notifying us of any unauthorized use of your account. Please be careful when disclosing information in public areas of the Website, as that information may be accessible to anyone.

10. DATA RETENTION

We apply a general rule of keeping Personal Information only for as long as is required to perform the purpose for which it was collected. However, in some circumstances, we will retain your Personal Information for longer periods of time. We will retain Personal Information for the following purposes: (1) as long as it is necessary and relevant for our operations; (2) to comply with statutory or other obligations to which Sygma is subject to; and (3) if and to the extent necessary, we need it to preserve evidence within the statutes of limitation. If you request deletion of your data, we will follow the process described in Section 12 (State Law Privacy Rights) below.

11. PERSONAL INFORMATION OF CHILDREN UNDER CHILDREN'S ONLINE PRIVACY PROTECTION ACT

Our Services are not intended for children under the age of 13, and we do not knowingly collect Personal Information from anyone under 13 years old. If you are under 13, please do not attempt to use our Services or send any Personal Information about yourself to us. In the event we learn that we have collected Personal Information from a child under 13, we will promptly delete that information from our records. If you believe that a child under 13 may have provided us with their information, please contact us using the information in the Contact section below so that we can take appropriate action.

Additionally, if you are between 13 and 16 years old and a resident of a jurisdiction like California that provides special rights for minors, you should only use the Services with involvement of a parent or guardian. We do not sell or share the Personal Information of consumers we actually know are less than 16 years old without affirmative authorization as required by law.

12. STATE LAW PRIVACY RIGHTS

Depending on your state of residence and subject to certain exceptions, you may have specific privacy rights under laws such as the California Consumer Privacy Act (CCPA), the Oregon Consumer Privacy Act (OCPA), the Colorado Privacy Act (CPA), and other state privacy laws.   • Request that we delete Personal Information related to you that we collected from you under certain circumstances and exceptions;
  • Correct the Personal Information you provided to us;
  • Obtain a portable copy of your Personal Information;
  • Opt out of selling or sharing your Personal Information; as defined under applicable state laws.
  • Opt out of targeted advertisement;
  • Not to be discriminated against for exercising your rights; and
  • Either limit or require consent to process sensitive Personal Information (e.g., health-related information).

To exercise your rights, as described above, please use the methods indicated in Section 12.1 or contact us as stated in Section 15 (Contact Information). We will verify your request using the information associated with your account and we may ask for a driver's license or other government-issued ID. You may also submit a request through an authorized agent so long as the agent is acting pursuant to a valid legal authorization (such as a power of attorney) or in the event of your incapacitation or death. We do not accept requests submitted by referral agents, third-party marketers, or other parties seeking to avoid contractual obligations (including referral fees) or act without your direct, legally valid authorization. Please see Section 2 (Consent and Opt-Out Rights) for more information regarding opt-out of the sale or sharing of your Personal Information.

13. EUROPEAN UNION VISITORS

While our Services are primarily intended for U.S. residents seeking our Services within the United States, we acknowledge that visitors from the European Union (EU), European Economic Area (EEA), or United Kingdom (UK) may access our App or Website.

Data Processing Notice

If you are an EU/EEA/UK resident, please review the following additional provisions which apply to your use of our Services:

Limited Applicability

We do not specifically market or target our Services to EU/EEA/UK residents. However, by voluntarily accessing our Website or Services, you acknowledge and agree that your Personal Information may be processed as described in this policy.

The controller of your Personal Information under the EU and UK General Data Protection Regulation (GDPR) is Sygma Labs, Inc..

Incidental Data Collection

We may collect limited Personal Information (such as IP address, browser information, and usage data) from all Website visitors, including those located in the EU/EEA/UK, as part of our standard operations.

Data Transfers Outside the EU/EEA/UK

Any Personal Information collected may be transferred to and processed in the United States, which may not provide an equivalent level of data protection. We implement appropriate safeguards for these transfers as required by applicable law.

To protect your data, we may request additional information to verify your identity before processing a data rights request. We may refuse requests that risk the privacy of others, are unfounded, or otherwise conflict with applicable law. Where permitted by law, we may charge a reasonable fee to process your request.

14. JOB APPLICANTS

When you apply for one of our open positions, we collect the information that you provide in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or that you may provide during the interview process. This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information. We also collect personal information from other sources where relevant for your application, such as employment research firms, recruiters, identity verification services, and information that you make publicly available on websites or social media platforms (for example, LinkedIn). Throughout the recruitment process, we may supplement your personal information in connection with the assessment of your application. For example, we may record the views of those considering your application about your suitability for the role for which you have applied and retain interview notes. If you accept an offer from us, your personal information will be incorporated into and used as part of your employee record.

15. CHANGES TO THIS PRIVACY POLICY

We may update or modify this Privacy Policy from time to time in response to evolving laws, changes in our business, or changes in our data practices. If we make material changes to the way we collect or use your Personal Information, or to other aspects of the Policy, we will provide you with notice as appropriate. This may include, for example, posting a prominent notice of the changes on our Website and/or emailing you if you have provided us with your email address.

The "Effective Date" at the top of this Privacy Policy indicates when the Policy was last revised. Any changes will become effective on the effective date indicated in the updated Policy.
